Terms and Conditions & Candidate Agreement

Location of Registration: Pune, Maharashtra, India

Please read these Terms and Conditions carefully.

By submitting an application, enrolling in the training program, or accepting pre-dispatch offerings with Urban Mobility Academy, you agree to be bound by all terms, conditions, covenants, and obligations stated herein.

1. Scope and Applicability

These Terms and Conditions (“Agreement”) govern the relationship between Urban Mobility Academy (UMA), headquartered in Pune, Maharashtra, India, and any individual applying for, enrolling in, or participating in UMA’s pre-departure delivery rider training, testing, or placement facilitation programs (hereinafter referred to as the “Candidate” or “Participant”).

Participation in the UMA two-week intensive training program, mock evaluations, and subsequent overseas employment placement processing is strictly conditional upon the Candidate’s full compliance with this Agreement, without exception or modification.

2. Candidate Selection, Deployment Timelines & Onboarding

Upon successful completion of the UMA training program and clearing the final mock evaluation, the Candidate will be issued a conditional job offer or selection notice for deployment to the United Arab Emirates (UAE). Once selected, the Candidate must join, deploy, and report for duty strictly within the timelines specified by UMA or its designated UAE operating partners.

Failure to deploy or report within the stipulated timeframe without prior written approval from UMA shall result in immediate forfeiture of the Candidate's selection, cancellation of visa processing, and liquidating damages as permitted under applicable law.

3. Operational Assignments, Platforms, Vehicles, and Transfers

Following the acquisition of a valid UAE driving license, the Candidate explicitly agrees to work on any delivery aggregator platform chosen exclusively at the discretion of the Company or its UAE deployment partner.

The Candidate shall operate strictly in the geographical zone(s) assigned and use the specific commercial motorcycle/vehicle issued by the Company.

The Company reserves the absolute, non-negotiable right to modify, change, or transfer the assigned delivery platform, operational zone, or issued vehicle from time to time based on operational requirements. The Candidate acknowledges and agrees that they shall have no right to object, choose, negotiate, or refuse any platform, zone, or vehicle assignment.

The Candidate’s placement and deployment are fully transferable. The Candidate agrees that their service location may be transferred to any Emirate, zone, or territory within the United Arab Emirates at any time as deemed necessary by the Company.

4. Employment Governance & UAE Labor Laws

Overseas employment contracts executed pursuant to successful UMA training shall be governed strictly by the Federal Decree-Law No. 33 of 2021 regarding the Regulation of Employment Relationships in the UAE (and any subsequent amendments thereto).

Candidates shall be subject to standard UAE labor regulations, including probationary periods, performance reviews, and official labor cancellation procedures.

5. Communication Mandates and Official Asset Usage

The Candidate shall maintain active, immediate communication at all times during employment. The Candidate agrees to always answer and respond to phone calls, WhatsApp messages, text messages, and official emails from Company representatives and dispatch coordinators without delay.

The Candidate must utilize the official SIM card/data line issued by the Company for all duty-related communications and app operations.

The official SIM card is provided strictly for business operations. The Candidate shall not misuse the official SIM card for personal downloads, unauthorized international calling, illegal web browsing, or secondary commercial purposes. Any cost incurred due to unauthorized usage or SIM card misuse will be deducted directly from the Candidate’s remuneration, without prejudice to further disciplinary action.

6. Duty Attendance, Cash Handling & Dual Employment

The Candidate shall strictly report for duty according to the shift rosters, schedules, and timeframes allocated by management. Unauthorized absenteeism or abandonment of shifts will lead to immediate termination.

The Candidate shall collect Cash on Delivery (COD) payments on behalf of the Company or platform in strict accordance with daily operating procedures. The Candidate shall not, under any circumstances, withhold, delay, misappropriate, or personally utilize cash collected on behalf of the Company. Failure to deposit collected funds within the mandated settlement window constitutes theft and will result in immediate police escalation and legal action.

The Candidate is employed on an exclusive, full-time basis. The Candidate shall not engage in, take up, or work for any secondary job, part-time work, side-gig, or alternative delivery company (whether online or offline) during their tenure.

If a Candidate is found undertaking unauthorized secondary employment or freelancing, the Company will initiate immediate legal action, file for employment visa cancellation, report labor law violations to UAE government authorities, and seek full financial damages.

7. Substance Prohibition, Zero Tolerance & Conduct Compliance

The Candidate shall not consume alcohol prior to or during operational shifts, nor while operating any Company-issued motorcycle or vehicle. Operating a vehicle under the influence of alcohol is strictly illegal and causes immediate termination and legal action.

The use, possession, sale, or distribution of illegal narcotics, psychotropic substances, or controlled drugs is strictly illegal under UAE Law. If a Candidate is found taking or possessing any narcotic substance, UMA and its UAE partners will immediately report the Candidate directly to the UAE Police and anti-narcotics authorities.

The Candidate must maintain strict professional decorum at all times. The use of abusive, offensive, profane, or derogatory language toward colleagues, managers, customers, or members of the public is strictly prohibited.

UMA maintains an absolute zero-tolerance policy regarding discrimination. The Candidate shall not make any racial, religious, ethnic, caste-based, or sectarian comments, jokes, or statements under any circumstances.

The Candidate shall not publish, post, broadcast, or stream any content, comments, videos, images, or complaints on social media platforms (including YouTube, Facebook, TikTok, Instagram, X/Twitter, or LinkedIn) regarding the Company, its UAE partners, operations, clients, work environment, or management. Any public defamation or unauthorized publication will face civil and criminal prosecution under UAE Cybercrime laws.

The Candidate agrees to abide by all human resource policies, standard operating procedures, safety guidelines, and direct operational instructions issued by Company officials from time to time.

8. Confidentiality & Proprietary Information

The Candidate acknowledges that during their training with UMA and subsequent employment, they will have access to confidential, proprietary information, including but not limited to: training materials, trade secrets, software applications, operating procedures, delivery algorithms, client lists, fee structures, and corporate relationships (“Confidential Information”).

The Candidate agrees that they shall not, during or at any time after their training/employment, disclose, copy, reproduce, or distribute any Confidential Information to any third party without express prior written consent from UMA.

9. Trademark and Intellectual Property Protection

All trademarks, service marks, trade names, logos, domain names, training courseware, digital content, mock test materials, and brand identifiers associated with Urban Mobility Academy (UMA) are the exclusive intellectual property of UMA.

Nothing in this Agreement grants the Candidate any right, title, license, or interest in or to UMA’s intellectual property. The Candidate shall not use the UMA name, logo, or brand materials for personal or commercial purposes without prior authorization.

10. Limitation of Liability & Disclaimers

While UMA provides structured training and mock evaluation preparation, passing the final mock test depends on the Candidate’s individual skill, attendance, and performance. UMA makes no warrantee that every applicant will automatically clear the evaluation without meeting the required standards.

To the maximum extent permitted by applicable law, UMA, its directors, partners, officers, employees, and agents shall not be liable to the Candidate for any indirect, incidental, consequential, special, or punitive damages arising out of or related to training, travel delays, government visa rejections, driving license test failures, or operational deployments.

UMA is not liable for delays or rejections caused by official regulatory bodies, including driving license institutes, UAE immigration authorities, medical fitness centers, or embassy visa processing departments.

11. Indemnification

The Candidate agrees to defend, indemnify, and hold harmless UMA, its parent entities, affiliates, partners, directors, and deployment partners from and against any claims, losses, liabilities, fines, traffic penalties, damages, expenses, or legal fees resulting from:

  • The Candidate’s breach of any term of this Agreement;
  • Traffic violations, accidents, or reckless driving committed by the Candidate;
  • Cash misappropriation or failure to remit collected funds;
  • Any illegal act, including drug possession, alcohol violations, cybercrime, or unauthorized secondary employment.

12. Governing Law and Jurisdiction

Matters related to the training, pre-screening, application fees, and contractual obligations executed in India shall be governed by and construed in accordance with the laws of India. Courts situated in Pune, Maharashtra, India shall have exclusive jurisdiction over any legal disputes arising prior to deployment.

Matters related to active employment, work permits, traffic compliance, and operational duties within the United Arab Emirates shall be governed by the federal laws of the United Arab Emirates.

13. Acknowledgment and Acceptance

By submitting an application to Urban Mobility Academy (UMA), the Candidate expressly acknowledges that they have read, understood, and unconditionally accepted all the terms, conditions, covenants, and restrictions outlined in this Agreement.
